Solanki
frame-up: Case classified as false, malicious

Mumbai: The sessions court on
Thursday classified the police case against estate
agent Rajesh Solanki as false and malicious, clearing
the decks for the prosecution of nine policemen who
were part of the frame-up. The two builders involved
in the conspiracy, Ravi Shelatkar and P Sundaram,
will face criminal action as well.
The case dates back to 2000,
when Shelatkar floated a redevelopment project in
Bhoiwada. He approached Solanki to arrange buyers for
the extra flats, which were to be built as part of
the redevelopment. Solanki collected around Rs 1.83
cr from various businessmen promising flats; when the
project did not take off, he demanded return of the
money collected from the prospective buyers.
Shelatkar came up with vague
excuses and went into hiding. In October 2004,
Solanki traced him to Ghatkopar and demanded the
money. Shelatkar promised to return the amount and
asked Solanki to meet him at his friend Sundarams
office in Jogeshwari.
Solanki went to Sundarams
office on Oct 19. Soon, Solanki got a call on his
mobile from Shelatkar who said he was in Delhi and
would not be able to make it. Solanki was asked to
come the next day.
When Solanki came out of the
building and was about to start his motorcycle, 7-8
policemen, including sub-inspector Raja Bhosale of
the Dongri police, allegedly put a plastic bag on him
and forced him into a waiting Tata Sumo.
When Solanki resisted,
Bhosale took out a revolver and threatened to kill
him in an encounter. They took him to the Dongri
police station where he was shown arrested for
possessing narcotic substances and an illegal
firearm. The police produced Solanki in the Mazgaon
court and showed that 340 gm of brownsugar and a
countrymade revolver had been recovered.
Solanki narrated the story to
then DCP (Zone I) Naval Bajaj, who transferred the
case to the MRA Marg police and initiated a probe
into the allegations. Bajaj and ACP N Tambevkar
initiated a departmental inquiry and concluded that
the case against Solanki was false and recommended
the dismissal of Bhosale. Bajajs seniors,
though, did not approve of it and the suspended Bhosale
was reinstated.
The MRA Marg police, after a
second probe, filed a report in the sessions court
last March urging it to classify the case under
B summary (false and malicious).
Bhosale and Shelatkar moved the Bombay HC, praying
that the FIR be quashed. Their petition was
dismissed. Investigating officer R Ambre said,We
are waiting for the court order and will start the
proceeding.
