The Judiciary
In March 2005, a Corrupt MPID ( Sessions) Judge V L Achilya,on instructions of Rs 1000 Crore fraudster, initiated a FIR against me, wife and son for living in property , allegedly sealed on his orders ( There was never any such order passed in HIS court ). So I was arrested , handcuffed and put in jail for 6 days, my wife and son were harassed, Rs 50, 000 extorted and the whole family truamatised, had to spend Lakhs on lawyers, for getting bail for myself and anticipatory bail for wife and son ... MPID ( Sessions) Judge N D Deshpande, who took over the case after V L Achilya was promoted to High Court, finally came to the conclusion on 30.1.2006, that there was "No order ever passed to seal the property nor any report submitted by the Police officer that he had sealed the property. The Police officer was only required to paste a notice on the property, which also he had not complied". Now though the same MPID court had initiated the FIR, it had no powers to cancel the FIR.
BUT this Judge N D Deshpande passed this order, after almost driving me and family to suicide, because he wanted to protect his predecessor Judge V L Achilya, by trying to force me and family out of the property and accepting, that we had "broken into a property sealed on orders of the court" ... For getting the FIR quashed, I had to approach the High Court, (which I had done, even before the order was passed by Judge N D Deshpande on 30.1.2006) . So in Cr WP / 2414/05 a order was passed on 15.2.2006, that "all proceedings relating to FIR 103/2005 registered at Khar Police Station be stayed, till final disposal of writ petition". (though 11 months had passed since my arrest in March 2005, no chargesheet had been filed yet, because in reality there was no case against me) .
The Police
Now the Khar Police got into 5th gear, after reading the MPID court orders, manupulated some records, and filed chargesheet in Bandra Magistrates court on 3.5.2006, in contempt of the High Court order. Later they said in RTI reply "Investigating officer was too busy, so did not get time to see High Court Order, so Chargesheet was filed inadvertently" (please understand chargesheet once filed cannot be withdrawn by the police, even if filed inadvertently) ... personally, the Investigating Rogue Inspector Vijay Dhatrak advised me "Do not waste time and money, in filing contempt application against me, maximum I will have to apologise to the High Court".
The Lawyer Disregarding the Rogue Inspectors advice, I filed contempt application, through my Rascal lawyer, who had taken fees in lakhs, who deliberately filed an Contempt Application guaranteed to fail. Worst, it was not thrown out by the High Court Judges immediately, but I was made to appear before 6 different two Judges Bench of the High Court for over 2 years, had to attend court atleast 20 times ... Basically the Bombay High Court Judges wasted my time and their own for 2 years before throwing out my Contempt Application ... Imagine what must be happening in smaller cities and towns of India ...
